Statutory Compliance We Manage Under the New Labour Codes

As of November 2025, India’s four Labour Codes — the Code on Wages, Code on Social Security, Industrial Relations Code, and the Occupational Safety, Health and Working Conditions Code — replaced 29 older central labour laws with a consolidated framework. Practically, this changed a few things employers need to know:

  • ESI coverage has expanded — establishments with 10+ employees are now covered in more categories and geographies than before
  • Final settlement of wages on an employee’s exit must now happen within 2 working days — a much tighter window than the older norm
  • Digital record-keeping for attendance, wages, and statutory registers is now mandated, not just recommended
  • The wage definition under the Code on Wages affects how basic pay vs. allowances are structured — artificially keeping basic pay low to reduce PF contribution is no longer compliant

On top of the Labour Codes, the Income Tax Act 2025 (effective 1st April 2026) replaced the 64-year-old Income Tax Act 1961 for TDS purposes — the underlying tax slabs and calculation logic haven’t changed, but section references, terminology (‘Tax Year’ replacing Assessment Year), and return formats (including Form 24Q) have been updated. Payroll systems and internal documentation referencing the old Act need updating.
